AstroPal ("Platform") is operated by R. Sivadas, a sole proprietor based in Karnataka, India (hereinafter referred to as "AstroPal", "we", "us", or "our"). The Platform provides AI-powered Vedic astrology services, including personalised birth chart readings, AI-generated astrological responses, reports, and related content ("Services").

These Terms of Use ("Terms") set out the terms on which you may access and use the Platform and any Services provided therein. These Terms apply to any individual who, whether acting personally or on behalf of any other person, accesses or uses the Platform or any Services, or otherwise visits the Platform (hereinafter referred to as "you", "your", or "User").

By accessing or using the Platform and/or any Services, you signify your agreement to be bound by these Terms and our Privacy Policy (currently located at http://www.astropal.ai which is incorporated herein by reference.

These Terms shall constitute an electronic record within the meaning of the Information Technology Act, 2000, the ancillary rules made thereunder, and all other applicable laws as amended from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.

IF YOU DO NOT ACCEPT THESE TERMS PRIVACY POLICY, DISCLAIMER AND REFUNDS POLICY IN THEIR ENTIRETY, YOU ARE NOT PERMITTED OR AUTHORISED TO ACCESS OR USE THE PLATFORM AND/OR ANY SERVICES. WE WILL NOT BE HELD LIABLE FOR ANY CONSEQUENCES OR LIABILITIES ARISING FROM YOUR UNAUTHORISED ACCESS TO OR USE OF THE PLATFORM.

1. Account

1.1 Upon visiting the Platform, you may browse and view general content without registration. However, to access and use the Services including generating birth chart readings, submitting queries to the AI, and accessing reports you will be required to register and create an account ("Account") on the Platform by providing certain personal information, which may include your name, date of birth, time of birth, place of birth, email address, contact number, and country of residence.

1.2 You agree to provide such other information as may be requested from time to time in order for you to be entitled to access any Services.

1.3 If any information that you provide on the Platform is untrue, inaccurate, not current, or incomplete, or if we have reasonable grounds to suspect the same, we have the right to suspend or terminate your Account and refuse any and all current or future use of the Platform or Services at our sole discretion, in addition to any right we may have against you at law or in equity.

1.4 You shall not have more than one active Account on the Platform. You are prohibited from transferring your Account to any third party or impersonating any other person for the purposes of creating an Account or accessing any Services.

1.5 You agree that your ability to access the Platform or use any Services is dependent upon external factors such as your device's compatibility with the Platform and internet network connectivity, and we shall not be liable for any inability to access the Platform arising from such factors.

1.6 You agree to access and use the Platform, your Account, and the Services in compliance with all applicable laws and only for the purposes for which they are intended.

1.7 While we have no obligation to monitor your access to or use of the Platform or Services, we reserve the right to do so for the purpose of operating the Platform, providing the Services, and ensuring compliance with these Terms and applicable law.

1.8 You may be held liable for losses incurred by us or any other User arising from any unauthorised use of your Account resulting from any breach or negligence on your part, including your failure to keep your Account credentials secure and confidential.

1.9 If your Account is terminated for any reason, we may delete information or materials relating to your use of the Platform, and we shall have no liability to you or any third party for doing so. However, certain transaction records and other details may be retained by us for tax, regulatory, or legal compliance purposes or as otherwise provided in our Privacy Policy.

1.10 You are eligible to use and access the Platform only if: (a) you have attained at least 18 years of age; and (b) you are competent to enter into a contract under applicable law. If you reside in a jurisdiction that restricts the use of the Platform because of age,or restricts the ability to enter into contracts such as these Terms due to age, you must abide by such age limits.

2. Nature and Scope of Services

2.1 The Services that AstroPal provides through the Platform include the following:

(a) AI-generated Vedic astrology readings and birth chart analyses based on your date, time, and place of birth, drawing on classical Vedic astrological texts and teachings;

(b) an AI-powered conversational interface through which you may submit questions and receive responses grounded in Vedic astrological tradition;

(c) written reports and personalised astrological content; and

(d) any other services as may be introduced by us from time to time.

2.2 The Services may be offered on a single-session basis, a per-report basis, or a subscription basis, as determined by us from time to time. The terms applicable to each offering will be notified to you at the time of purchase.

2.3 You agree to access and use the Services only for the purposes for which they are made available and in accordance with these Terms.

3. No Professional Advice Disclaimer

3.1 The Services provided by AstroPal are offered for entertainment, informational, and personal reflection purposes only. Vedic astrology is a traditional knowledge system and not an empirical science. All readings, chart analyses, AI-generated outputs, and other content provided through the Platform are speculative, subjective, and interpretative in nature. AstroPal does not guarantee the accuracy, reliability, or outcome of any reading, prediction, or content.

3.2 The Services do not constitute and must not be relied upon as:

(a) medical, psychiatric, or mental health advice or diagnosis;

(b) legal advice;

(c) financial, investment, or tax advice;

(d) relationship or marriage counselling; or

(e) any other form of professional advice or treatment.

3.3 You must consult appropriately qualified professionals for all matters relating to your health, finances, legal affairs, mental wellbeing, or safety. You expressly agree that you will not rely on any content provided through the Platform for critical decisions in these or any other areas.

3.4 Any advice, content, or output generated through the Platform, whether by AI or otherwise, shall not under any circumstances be treated as professional advice, and reliance on any such content shall be solely at your own risk.

4. AI-Generated Content and Limitations

4.1 Some or all of the outputs generated through the Platform may be produced by AI models. You acknowledge and agree that:

(a) AI-generated outputs may contain inaccuracies, errors, or outputs that do not reflect factual reality;

(b) responses generated by the AI are based on patterns derived from classical Vedic astrological texts and your inputs and do not represent verified fact;

(c) you are solely responsible for how you interpret, use, or act upon any AI-generated content; and

(d) no AI-generated output constitutes a guarantee of any outcome or result.

4.2 AstroPal expressly disclaims all liability for any loss, harm, or consequence arising from your reliance on AI-generated content.

5. Services Fee and Billing

5.1 Certain Services on the Platform are offered on a paid basis. The fee payable for such Services ("Services Fee") will be notified to you at the time of purchase or subscription.

5.2 The Services Fee for any Service you select is fully payable at the time of registration for or purchase of that Service. Unless otherwise agreed, you will not be permitted to access any paid Service before full payment of the applicable Services Fee.

5.3 You acknowledge and agree that we may use third-party payment gateway providers to process and facilitate your payment of Services Fee. You will be required to comply with the terms and conditions of such payment gateway providers in connection with the processing of payment. We shall not be liable for any actions or omissions of third-party payment gateway providers.

5.4 The payment of Services Fee may be made through such methods as notified to you at the time of payment. You agree to bear all charges that may be incurred in the course of processing such payment, including applicable taxes.

5.5 We reserve the right to amend the Services Fee, subscription plans, or billing cycles at our sole discretion and at any time. You will be given advance notice of any such change, and your continued use of the relevant Services following such notice shall constitute your acceptance of the revised fees or terms.

5.6 Subscription plans, where offered, may renew automatically at the end of each billing cycle unless cancelled by you in advance of the renewal date in accordance with the cancellation process notified to you on the Platform.

5.7 In the event of any disputed payment or complaint related to payment processing, we will pass on the dispute or complaint to the concerned payment gateway provider for resolution.

6. Refunds and Cancellations

6.1 Digital Nature of Services. The Services provided by AstroPal are digital in nature, including AI-generated readings, personalised astrology reports, premium content, consultations, and credits. These Services are intangible and are in many cases delivered instantly or customised specifically for you upon purchase. Due to the nature of digital delivery and personalisation, refunds are generally not available once a Service has been delivered or activated.

6.2 No Refund --- Standard Position. Unless explicitly stated otherwise at the time of purchase or as provided in Clauses 6.4 and 6.5 below, all payments made on the Platform are final and non-refundable. This applies to, without limitation:

(a) premium subscription plans;

(b) paid horoscope or astrological reports;

(c) AI-generated personalised readings;

(d) consultation fees;

(e) credits or tokens purchased on the Platform;

(f) downloadable or otherwise delivered digital content; and

(g) add-on services or premium features.

6.3 Subscription Cancellation. Where you have subscribed to any Services on a recurring basis, you may cancel your subscription at any time through your App Store or Play Store subscription settings, or through your Account settings on the Platform where such functionality is available. Cancellation will take effect at the end of the then-current billing period, and you will retain access to the relevant Services until that date. No partial or pro-rated refunds will be provided in respect of any unused portion of a subscription period. We reserve the right to amend subscription plans, fees, or billing cycles on advance notice to you, and your continued use of the relevant Services following such notice shall constitute acceptance of the revised terms.

6.4 Refund Exceptions. A refund may be considered, at AstroPal's discretion, only in the following limited circumstances:

(a) Duplicate payment: where you have been charged more than once for the same transaction due to a verified technical error on the Platform, the duplicate charge will be refunded;

(b) Service not delivered: where payment has been successfully processed but the relevant Service has not been delivered due to a verified technical failure on our part, we will, at our election, either deliver the Service again or issue a refund of the amount paid; and

(c) Legal requirement: where a refund is required under applicable consumer protection law or any other mandatory applicable law, we will issue a refund to the extent so required.

6.5 Consultations. Where AstroPal offers live consultations with a human astrologer or advisor, the following terms apply:

(a) if you cancel a booked consultation before the session begins, your eligibility for a refund will depend on the cancellation window communicated to you at the time of booking, and no refund will be available outside that window;

(b) if you are unavailable at the time of the scheduled session for any reason, no refund will be provided and the session will be deemed to have been forfeited; and

(c) if the astrologer or advisor engaged by AstroPal fails to attend the scheduled session, you will be offered either a rescheduled session at a mutually convenient time or a full refund of the consultation fee paid, at your election.

6.6 Chargebacks and Payment Disputes. If you initiate a chargeback or payment dispute with your bank, card issuer, or payment provider without first contacting AstroPal support at support@astropal.ai and allowing us a reasonable opportunity to resolve your concern, we reserve the right to suspend or terminate your Account, block future purchases, and deny access to any Services purchased by you. Initiating a chargeback without following the procedure set out in Clause 6.7 below may be treated as a breach of these Terms and may result in the consequences set out in Section 14.

6.7 How to Request a Refund. To request a refund in any case where you believe you are eligible under Clause 6.4 or 6.5, please contact us at support@astropal.ai with the following information:

(a) your registered email address and/or contact number;

(b) the transaction ID or order reference;

(c) the payment method used;

(d) the date of the transaction; and

(e) a detailed description of the reason for your refund request.

We will review and respond to your request within 7 to 14 business days of receipt. We may request additional information from you to verify your identity or the transaction before processing any refund.

6.8 Processing Time. Where a refund is approved, the refund will be processed to the original payment method used for the transaction. Indicative processing timelines are as follows:

(a) credit or debit cards: 5 to 10 business days from the date of approval;

(b) UPI or digital wallets: 7 to 15 business days from the date of approval; and

(c) in all other cases, as per the processing cycle of the relevant payment gateway provider.

AstroPal shall not be responsible for any delay in processing caused by your bank, card issuer, or payment provider once the refund has been initiated from our end.

6.9 No Refund on Termination for Breach. If your Account is suspended or terminated due to a breach of these Terms, you will not be entitled to any refund of any Services Fee or other amount paid by you, irrespective of whether any Services have been delivered.

7. User Responsibilities and Prohibited Conduct

7.1 You agree that you will:

(a) provide accurate, current, and complete information during registration and at all times during your use of the Platform;

(b) maintain the confidentiality of your Account credentials and notify us immediately at hello@astropal.ai if you become aware of any unauthorised use of your Account;

(c) use the Platform and Services only for lawful purposes and in accordance with these Terms; and

(d) comply with all applicable laws in your jurisdiction when accessing or using the Platform.

7.2 You must not:

(a) copy, reproduce, distribute, sell, resell, or commercially exploit any content from the Platform without our prior written consent;

(b) attempt to hack, reverse engineer, decompile, disassemble, or otherwise circumvent or interfere with the Platform or any of its security measures;

(c) scrape, harvest, or extract data or content from the Platform by automated means or otherwise;

(d) upload, transmit, or otherwise introduce any virus, malware, or harmful code to the Platform;

(e) impersonate any person or entity or misrepresent your identity or affiliation with any person or entity;

(f) use the Platform or any content derived from it for any purpose that is fraudulent, deceptive, manipulative, or harmful to any person;

(g) use the Platform to promote or facilitate hate, violence, harassment, discrimination, or any illegal activity; or

(h) engage in any conduct that, in our reasonable judgment, damages or is likely to damage the reputation, integrity, or operation of the Platform or its users.

7.3 Violation of any obligation under this Section shall entitle us to suspend or terminate your Account and access to the Platform and Services, without prejudice to any other rights or remedies available to us.

8. User Content and Communications

8.1 If you submit any content through the Platform including birth details, queries, feedback, comments, or reviews ("User Content") you grant AstroPal a non-exclusive, royalty-free, worldwide licence to use, process, store, and analyse such User Content for the purposes of providing, improving, and developing the Services, conducting analytics, and providing customer support.

8.2 Where User Content is used for purposes of AI model improvement, it will first be anonymised or pseudonymised in accordance with our Privacy Policy.

8.3 You confirm that all User Content you provide is lawfully yours to share and does not infringe the rights of any third party, including any intellectual property rights or privacy rights.

9. Intellectual Property

9.1 All intellectual property in the Platform and its contents including trademarks, logos, software, UI design, reports, AI outputs, articles, and all other materials belongs to AstroPal or its licensors. Nothing in these Terms transfers any intellectual property rights to you.

9.2 You are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform and the Services for your personal, non-commercial use, strictly in accordance with these Terms.

9.3 You may not reproduce, distribute, publicly display, or create derivative works from any content on the Platform without our prior written consent.

10. Third-Party Links and Services

10.1 The Platform may contain links to or integrations with third-party websites, applications, or services. AstroPal is not responsible for the content, privacy practices, or terms of any third-party service.

10.2 Any transactions or interactions you have with third parties through or in connection with the Platform are solely between you and the relevant third party. We shall not be liable for any loss or damage arising from such interactions.

10.3 Use of third-party services linked from the Platform is at your own risk and subject to the relevant third party's terms and policies.

11. Disclaimer of Warranties

11.1 The Platform and Services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express or implied.

11.2 AstroPal does not represent or warrant that:

(a) the Services will meet your specific requirements or expectations;

(b) the Platform will operate uninterrupted, error-free, or free from viruses or other harmful components;

(c) any reading, prediction, or AI-generated output will be accurate, reliable, or complete; or

(d) the results of using the Services will meet your expectations.

11.3 To the maximum extent permitted by applicable law, we disclaim all implied warranties including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

12.1 You agree to indemnify, defend, and hold harmless AstroPal and its affiliates, employees, agents, service providers, and representatives ("Indemnified Persons") from and against any and all losses, liabilities, claims, damages, demands, costs, and expenses (including reasonable legal fees and disbursements) asserted against or incurred by the Indemnified Persons that arise out of, result from, or are payable by virtue of:

(a) any breach or non-performance of any representation, warranty, or obligation made or to be performed by you under these Terms;

(b) your use of or access to the Platform or Services;

(c) any misrepresentation with respect to the data or information provided by you; or

(d) your violation of any rights of any third party, including any intellectual property rights or privacy rights.

13. Limitation of Liability

13.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASTROPAL SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR ACCESS TO THE PLATFORM OR SERVICES, INCLUDING WITHOUT LIMITATION: EMOTIONAL DISTRESS, LOST PROFITS, MISSED OPPORTUNITIES, RELATIONSHIP OR FAMILY DISPUTES, FINANCIAL LOSSES, MEDICAL OUTCOMES, OR DECISIONS MADE IN RELIANCE ON ANY CONTENT PROVIDED THROUGH THE PLATFORM.

13.2 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ASTROPAL'S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT OF SERVICES FEE ACTUALLY PAID BY YOU IN THE THREE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ₹1,000 (ONE THOUSAND RUPEES), WHICHEVER IS LOWER.

13.3 If applicable law does not permit the exclusion of certain warranties or the limitation or exclusion of liability, the scope and duration of such warranty exclusions and the extent of our liability shall be the minimum permitted under applicable law.

13.4 We shall not be held responsible for any failure to perform or delay in performance of our obligations under these Terms attributable to a Force Majeure Event, meaning any event beyond our reasonable control including, without limitation, fire, flood, explosion, acts of God, civil commotion, epidemic or pandemic, war, acts of terrorism, acts of governmental or judicial authority, unavailability of communications systems, technical or software failure, electrical outages, internet failures, computer hacking, or unauthorised access to the Platform's systems.

14. Termination

14.1 AstroPal may suspend or terminate your Account and access to the Platform or any Services at any time, with or without notice, if you violate these Terms, if required by applicable law, or for any other reason at our sole discretion.

14.2 You may cease using the Platform at any time. If you wish to delete your Account, please contact us at hello@astropal.ai.

14.3 Upon termination of your Account for any reason, all licences granted to you under these Terms will immediately cease. Clauses that by their nature should survive termination including Sections 3, 4, 8, 9, 12, 13, 15, and 16 shall continue to apply.

15.3 We will endeavour to redress your grievances within such timeframe as stipulated under applicable law.

16. Governing Law and Jurisdiction

16.1 These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of laws principles.

16.2 All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Bengaluru, Karnataka, India.

17. Changes to Terms

17.1 We may update or amend these Terms at any time by updating this page. We will endeavour to inform you of material changes in accordance with applicable law. Your continued use of the Platform following the posting of any changes constitutes your binding acceptance of the updated Terms.

18. Severability

18.1 The invalidity or unenforceability of any provision of these Terms, in whole or in part, in any jurisdiction shall not affect the validity, legality, or enforceability of the remainder of these Terms, which shall continue to operate to the fullest extent permissible under law.
